What kind of birds does he have? That makes a big difference. You can use exotic birds for those things. As far as I'm aware, you can't exploit native birds for profit, unless it is regulated under an education permit. But as far as movies go, I don't really know if that's legal.

if anyone watches smallville they did a switch up with a harris on a post followed making the same bird a RT when it landed in a tree also a harris was used in the movie skinwalkers but i just looked that up and it was a canadian film so maybe that is how they did it
a golden eagle was just used in a will smith movie. i think one that is coming out. you should see it for that. will smith is falling down the building with a golden eagle flying next to him.
Its not that you can't use a "bird of prey" in a movie, its that the falconer is not supposed to make money from it without a special permit issued by USFWS. I do know a couple guys in California who work for the movie industry and use "exotic" birds in commericial's. There are a couple of brothers in the Simi Valley who do this kind of work and another guy in Mira Loma, Ca. One year they had an Auger Buzzard in a Budwiser commerical. There are ways around the "getting paid" issue such as paying the person for being a consultant. If there is money involved, they will find a way to get to it.
i know the two brothers in simi valley ca. they are amazing guys. got some really cool birds. they have a business called avain entertainment. they do all kinds of movies. they did the comercial called the christmas hawk.
It is so true if there is a way around laws to make money; people will find a way.
its to my knowledge that these are for sure not falconry birds. I know a guy who does a birds of prey demonstration for audiences and those are all covered under an education permit, he gets paid for those. He is also a falconer with a red tail. hes not allowed to fly it in the show because it does not fall under that permit. I am not sure about all the regs but this has been my experience.
